These Terms & Conditions (“Terms”) govern your access to and use of the Cassandra Renée website, online store, products, content and associated services (collectively, the “Services”).

Throughout these Terms, “Cassandra Renée”, “we”, “us” and “our” refer to Cassandra Renée, ABN 27 483 877 331.

By accessing or using our website or purchasing from Cassandra Renée, you agree to these Terms together with any policies referenced within them, including our Privacy Policy, Shipping & Delivery Policy and Returns Policy.

Please read these Terms carefully before using our Services.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available to you under the Australian Consumer Law or any other law where such rights cannot lawfully be excluded.

1. USING OUR WEBSITE

2. OUR COLLECTIONS & PRODUCTS

We take reasonable care to ensure that Cassandra Renée products are represented as accurately as possible through our website.

While we aim to accurately display the colours, textures, proportions and details of our garments, the appearance of products may vary depending on your device, screen settings and display.

Certain Cassandra Renée pieces incorporate delicate, natural or speciality fabrics and finishes. Minor variations in colour, texture, weave, embellishment or finish may occur between individual pieces and may be inherent characteristics of the material or method of construction rather than a fault.

Product measurements and sizing information are provided as a guide. We recommend reviewing the relevant product information and Size Guide before purchasing. If you require assistance selecting your size, please contact Customer Care prior to placing your order.

We may update our collections, product descriptions or availability from time to time and may discontinue products or limit quantities available for purchase.

3. PRODUCT AVAILABILITY

Cassandra Renée is committed to considered production and may produce collections in limited quantities.

Products displayed on our website are subject to availability. Placement of a product on the website does not guarantee that it will remain available for purchase.

Where an item becomes unavailable after an order has been placed, we will contact you as soon as reasonably practicable and, where we are unable to fulfil the order, provide a refund of the amount paid for the unavailable item.

4. PLACING AN ORDER

By placing an order through our website, you are making an offer to purchase the selected product or products in accordance with these Terms.

After your order is submitted, you will receive an order confirmation at the email address provided during checkout. This confirms that we have received your order.

An order is accepted once payment has been successfully processed and we have accepted the order for fulfilment.

Please review your order carefully before completing checkout, including your selected products, size, quantity and delivery details.

Once an order has entered processing or fulfilment, we may be unable to accommodate changes or cancellations.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • payment cannot be authorised or processed;
  • incorrect pricing or product information has been displayed;
  • delivery information is incomplete or invalid;
  • we reasonably suspect fraudulent, unauthorised or unlawful activity; or
  • fulfilling the order would breach applicable law.

If we cancel an order after payment has been received, we will refund the relevant amount to the original payment method.

Products purchased from Cassandra Renée are intended for personal use and must not be purchased for unauthorised commercial resale.

Cassandra Renée currently accepts online orders for delivery within Australia only.

5. PRE-ORDERS

From time to time, selected Cassandra Renée pieces may be made available for pre-order in limited quantities.

A pre-order allows you to purchase and reserve a piece prior to its availability for immediate dispatch.

The estimated dispatch date or timeframe for a pre-order will be displayed on the relevant product page at the time of purchase.

Unless otherwise stated, payment for a pre-order is processed in full at the time the order is placed.

Pre-order purchases cannot be cancelled or amended once the order has been submitted. Please review your selected style, size, quantity and delivery details carefully before completing your purchase.

Pre-order dispatch dates are estimates. While we take reasonable steps to meet the timeframe communicated at the time of purchase, production, quality control, freight or other circumstances outside our reasonable control may occasionally result in a delay.

If a material delay affects your pre-order, we will endeavour to notify you using the contact information provided with your order and advise you of the options available.

If we are unable to fulfil a pre-order, we will notify you and refund the amount paid for the affected item to your original payment method.

Where an order contains both available and pre-order products, the applicable dispatch arrangements will be communicated through our website or checkout.

Nothing in this section limits your rights under the Australian Consumer Law.

6. PRICING & PAYMENT

All prices displayed on the Cassandra Renée Australian website are in Australian Dollars (AUD) unless otherwise stated.

Prices may change from time to time. Any price change will not affect an order that has already been accepted, except where permitted by law.

Applicable delivery charges will be displayed at checkout before you complete your purchase.

You agree to provide accurate and complete billing and payment information and confirm that you are authorised to use the payment method provided.

If we discover an obvious pricing, product or technical error affecting your order, we may contact you to correct the error. Where an affected order cannot reasonably be fulfilled, we may cancel it and refund any amount paid.

7. SHIPPING & DELIVERY

Cassandra Renée currently delivers within Australia only.

Please allow approximately 1-3 business days for processing and handling prior to dispatch, regardless of the shipping method selected.

Standard Shipping - $12 AUD
Following dispatch, Standard Shipping orders are generally expected to arrive within 2-5 business days.

Express Shipping - $15 AUD
Following dispatch, Express Shipping orders are generally expected to arrive within 1-3 business days.

Delivery timeframes are estimates and commence from the date of dispatch.

Delivery times may vary depending on destination, carrier operations and circumstances outside our reasonable control.

During collection launches, sales, promotional periods and other peak periods, order processing and shipping may experience slight delays.

Once your order has been dispatched, you will receive shipping confirmation and tracking information using the contact details provided with your order.

Please ensure that your delivery information is complete and accurate when placing an order.

8. RETURNS, EXCHANGES & YOUR CONSUMER RIGHTS

Returns and exchanges are handled in accordance with our Returns Policy.

Our Returns Policy operates in addition to, and does not replace or limit, your rights under the Australian Consumer Law.

Products sold by Cassandra Renée come with consumer guarantees that cannot be excluded under Australian law. These include guarantees relating to acceptable quality, fitness for purpose and correspondence with product descriptions.

Depending on the circumstances and whether a failure is major or minor, you may be entitled to a repair, replacement, refund, compensation or another remedy provided by law.

Nothing in these Terms or our Returns Policy is intended to exclude or limit those rights.

9. GARMENT CARE

Cassandra Renée garments may incorporate delicate and speciality materials requiring considered care.

Please follow the care label attached to your garment and any additional garment-care information supplied with your purchase or displayed on the relevant product page.

Where a product requires professional dry cleaning or other specialist treatment, this will be identified through the applicable care instructions.

Damage caused by misuse, accidental damage, failure to follow reasonable care instructions or normal wear and tear is not necessarily considered a product failure.

Nothing in this section limits any rights you may have under Australian Consumer Law.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, all content appearing on the Cassandra Renée website is owned by, or licensed to, Cassandra Renée and is protected by applicable intellectual property laws.

This includes, without limitation, the Cassandra Renée name and logo, trademarks, original garment designs, prints, patterns, artwork, illustrations, written content, product names, graphics, photography, campaign imagery, video, audio, website content and other creative material.

Our website and its content are provided for your personal and non-commercial use.

You must not reproduce, copy, modify, distribute, publish, transmit, display, commercially exploit, create derivative works from or otherwise use Cassandra Renée content without our prior written permission, except where permitted by law.

Nothing contained on our website grants you any licence or right to use Cassandra Renée intellectual property except as expressly permitted by these Terms.

11. REVIEWS, FEEDBACK & SUBMISSIONS

If you voluntarily provide us with feedback, suggestions, reviews, photographs, comments or other material relating to Cassandra Renée or our products, you confirm that you have the right to provide that material and that doing so does not infringe another person’s rights.

The Cassandra Renée online store is powered by Shopify, which provides the ecommerce technology used to operate our online store.

When you purchase a Cassandra Renée product through our website, your contract for the purchase of that product is with Cassandra Renée.

Shopify and other service providers may process certain information where necessary to facilitate our website, payments and Services. Further information about the handling of personal information is provided in our Privacy Policy.

This provision does not limit any liability or responsibility of Cassandra Renée that cannot lawfully be excluded.
